Job Title: Assistant/Associate General Counsel
Salary Level: $75,000 – $120,000 depending on experience
FLSA Status: Nonexempt
Location: HQ
Shift: Day
Reports To: General Counsel

SUMMARY
Represents Ohio Council 8 (“Council 8”) and its affiliate locals in civil lawsuits, administrative agency hearings, arbitration hearings, civil service hearings, labor disputes, and other similar types of hearings; prepares legal documents; advises Council 8 and its affiliates regarding legal rights and the law; and practices other phases of law as assigned and in performing the following duties.

EDUCATION, LICENSING and EXPERIENCE: Juris Doctor Degree and License to practice law in Ohio required. Admission to practice before the United States Southern and Northern District Courts and the Sixth Circuit Court of Appeals required or obtained within six months of date of hire. Assistant General Counsel position requires at least two (2) years of attorney experience. Associate General Counsel position requires at least three (3) years of experience as a labor attorney.

Basic knowledge of public and private sector labor and employment law and knowledge of state and federal rules of civil procedure and rules of evidence is required.

ESSENTIAL DUTIES AND RESPONSIBILITIES include the following:

  1. Performs legal and other research as needed or assigned.
  2. Reviews and analyzes legislation; interprets laws, rulings, and regulations.
  3. Gathers facts and evidence to formulate a defense or to initiate legal action; develops legal strategy for the case; interviews and prepares witnesses; conducts witness direct and cross examinations; prepares legal briefs and other documents; prepares and presents testimony in preparation for presentation of cases. Files brief with court clerk.
  4. Represents Council 8 and its local affiliates in state, federal and appellate courts, before quasi-judicial or administrative agencies of government, and before mediators and arbitrators.
  5. Advises Council 8 and its local affiliates concerning transactions of business involving internal affairs, officers and relations with the general public.
  6. Drafts and/or prepares business contracts, settlement agreements, legal opinions and memoranda, complaints, answers, motions, oral arguments, briefs and administers other legal matters.
  7. Confers with colleagues with specialty in area of lawsuit to establish and verify basis for legal proceedings.
  8. Reviews and responds to civil complaints and/or administrative charges filed against the Council and/or affiliated local unions.
  9. Drafts, files, and litigates charges and responses before the Equal Employment Opportunity Commission (EEOC) and/or Ohio Civil Rights Commission (OCRC).
  10. Prepares cases before the Ohio Personnel Board of Review (PBR) regarding appeals on behalf of members, local unions or Council 8.
  11. Drafts, files, and litigates representation petitions and unfair labor practice charges and responses before the State Employment Relations Board (SERB) and the National Labor Relations Board (NLRB).
  12. Responsible for keeping updated as to the current state of the law.
  13. Responsible for assuring compliance of arbitration, administrative and civil orders.
  14. Drafts correspondence to staff, employers, and other representatives.
  15. Reviews contracts for services to be entered into by Council 8.
  16. Handles real estate transactions entered into by Council 8.
  17. Attends and participates in AFSCME and other labor organization attorney meetings and conferences as approved, and in local union meetings to address legal issues of concern to the local or its members.
  18. Maintains a log of daily activities.
  19. Other duties as assigned by the General Counsel.

MATHEMATICAL SKILLS: Ability to apply concepts such as fractions, percentages, ratios, and proportions to practical situations.

REASONING ABILITY: Ability to apply principles of logical or scientific thinking to a wide range of intellectual and practical problems. Ability to deal with nonverbal symbolism (formulas, scientific equations, graphs, musical notes, etc.,) in its most difficult phases. Ability to deal with a variety of abstract and concrete variables.
