POSITION TITLE: Legal Counsel

POSITION DESCRIPTION:
MNA’s Legal Counsel provides a variety of legal services to protect and advance the rights of MNA and its members; actively supports the Association’s programs, policies, and initiatives to strengthen the organization’s power through member engagement and organizing; and represents the Association and its members in proceedings in various venues including before arbitrators, administrative agencies, and state and federal courts.

KEY RESPONSIBILITIES:

  • Professionally represent the Association in arbitrations, bargaining unit determination, bargaining unit clarifications, employment-related administrative hearings, unfair labor practice filings and court proceedings including before the National Labor Relations Board, Public Employment Labor Relations Board or Federal Court.
  • Provide timely and accurate written and verbal legal advice to Association staff and member groups on a variety of issues including, but not limited to labor law, employment law, public and private sector collective bargaining and labor relations and other areas of the law relevant to MNA’s union activities.
  • Monitor developments and trends in labor law, employment law, and recent arbitration decisions, inform the Director of Field Operations of developments that may impact the Association or its members.
  • Review Association policies and procedures applicable to its members for legal compliance and risk mitigation; recommend changes as needed.
  • Engage in legal research and writing of varying degrees of complexity.
  • Develop and maintain effective working relationships with counsel from affiliated organizations and outside legal consultants.
  • In coordination with MNA’s Education Specialist, prepare and present educational programs regarding aspects of collective bargaining, labor law, and employment law for staff and members as requested.
  • Perform other duties as assigned, including, but not limited to duties normally assigned to Labor Relations Specialists which includes acting as a chief negotiator in negotiating collective bargaining agreements for organized bargaining units and investigating potential contract violations and representing nurses throughout the grievance process.
  • Handle cases in a timely manner, and keep union staff and members informed regarding case status and progress.
  • Maintain demonstrated effectiveness when subjected to conflict, tension or stress-producing circumstances.
  • Perform job functions with personal integrity and in an ethical manner.
  • Will advise on external and internal organizing campaigns and ensure documents issued by Labor Relations Specialists and Organizers are accurate and in legal compliance.
  • Will advise on issues that arise in the MNA Membership Department and ensure that documents issued by the Membership Department are accurate and in legal compliance.
  • Occasional travel is required.
  • Expected to work occasional nights and weekends.

SKILLS AND QUALIFICATIONS

  • Demonstrated commitment to labor unions.
  • JD from a nationally accredited institution and admitted to practice in Minnesota and the Federal District Court of Minnesota.
  • At least two (2) years of experience in the practice of public and or private sector labor law. Additional experience in the practice of law in one or more of the following areas of the law preferred: state and federal employment laws, including discrimination, whistleblower, medical leave and wage acts, unemployment law and federal and state constitutional laws.
  • Excellent verbal skills for oral advocacy, negotiations, mediation, training and client communication.
  • Demonstrated ability to write clearly and persuasively.
  • Strong analytical skills.
  • Strong investigation and research skills.
  • Ability to work quickly and creatively to handle multiple assignments simultaneously and to function well both independently and as part of a team.
  • Other combinations of education and experience which could provide the necessary knowledge and skills will be evaluated on an individual basis.
  • Experience administering collective bargaining agreements.
